The end of free EU travel and changes to UK immigration laws mean that from 1 January 2021, all EU and non-EU individuals coming to work in the UK will now be subsidized by a licensed subsidiary employer.

The new UK points system includes a migration path for employees assigned to a qualified role from a recognized sponsor. The new policy for a competent worker in place of the Category 2 (General) visa applies to both:

  • Non-EU companies applying for visas on or before December 1, 2020.
  • Companies in the EU that have entered the UK on 31st December 2020.

EU companies already residing in the UK are no longer required to provide funding as of 31 December 2020. Irish countries are also exempt from the rules and do not need money to work in the UK.

With new changes being introduced it has now become difficult for employers to hire workers from abroad as they are required to hire employees with a high skill set only and the minimum salary requirements have also been upgraded to higher levels compared to the previous Tier 2 visa route.

The primary route for non-UK citizens in the UK is:

  • One-time skilled Employee Visa (which replaces Tier 2 Visa)

  • Section 5 of the Temporary Employment Visa

During the application process, Home Office assesses whether the applicable fit in requirements of getting a sponsor license or not. The Home Office processes the grant applications with the help of the general client applications team.

There is no limit to the size or type of organization holding a sponsorship license, as long as it meets the eligibility requirements of a particular category or application category. If you do not meet the established criteria, your application will be rejected. Some people are also required to be their families in the UK and hence need to have a job, they need to comply with family law to legalize their stay in the UK

Eligibility criteria

1. The company should be a legitimate legal entity conducting business in the UK

The organization must be legal and registered with the relevant authorities.

The company has no rules for doing business at any time, but you must be a UK resident working for the company to contact the Home Office for any questions regarding the application.

2. The company is based in the UK

If you do not have any business presence or are not currently working in the UK, your rejection chances are extremely high. Even if the company does not live on a UK campus and uses a visible business model, it can still apply for a sponsorship license. However, it requires clear evidence that it can fulfil its sponsorship duties and responsibilities and is legally operating or doing business in the UK.
